Plaintiffs allege Defendant sells its line of high-sugar BelVita breakfast products that specifically targets consumers “who have health and wellness in mind” despite overwhelming evidence that sugar acts as a chronic liver toxin.

Cohen v. East West Tea Company, LLC, No. 3:17-cv-02339 (S.D. Cal.): Putative class action for violation of California’s UCL, FAL and CLRA and asserting claims for breach of express warranties. Plaintiff alleges Defendant promotes and sells its Yogi Green Tea Kombucha products as products comprised of a proprietary blend of herbs, including Organic Kombucha.

Goldstein v. Kreation Juicery, Inc., No. BC684218 (Cal. Super. Ct. – Los Angeles Cnty.): Putative class action asserting violations of California’s UCL and CLRA, and raising claims for fraud and deceit, and negligent misrepresentation. Plaintiff alleges Defendant marketed and promoted its juice and supplement products by falsely claiming the products were proven to reduce malignant tumors, cure autism and aid in the treatment of cancer.

Yamini v. Eden Creamery, LLC, No. BC684736 (Cal. Super. Ct. – Los Angeles Cnty.): Putative class action asserting violations of California’s FAL and UCL, and raising claims for breach of express and implied warranties. Plaintiff alleges Defendant falsely advertises its ice creams and frozen desserts as “all natural,” when in fact the products contain added colors, guar gum and alkalized cocoa.
